
Picture this: you’re a new medical science liaison (MSL) at a top pharma company. It’s Day 1. You walk into the Head of Medical Affairs’ office and say, “I’d like to start customer meetings on Monday.“
You’d be laughed out of the building.
And rightly so—because in this highly-regulated industry, no human representing a pharmaceutical, biotech, or medical device company gets anywhere near a healthcare provider (HCP) without first going through a rigorous training and certification process. Yet right now, across the industry, AI tools and agents that have not been certified are being used by customer-facing teams, introducing massive risk.
This is a big part of the Compliant AI problem.
To be compliant, AI systems must be governed, auditable, and held to the same regulatory and ethical standards as the humans they support. It’s not a feature or a nice-to-have. In Life Sciences, it’s a baseline requirement—we just haven’t started treating it like one.
Left unsolved, this is a compliance time bomb. The clock is already ticking. In fact, 55% of pharma leaders cite compliance and validation as the top challenge to agentic AI deployment. The problem is widely recognized. What’s missing is a systematic response to it.
Why the Industry Needs Guardrails
The compliance infrastructure that governs customer-facing roles in pharma didn’t appear overnight. It was built piece by piece, often in response to costly failures.
For example, federal lawmakers in the United States implemented the Sunshine Act in 2010, which “requires certain manufacturers of covered drugs, medical devices, and biologics or medical supplies to collect and report detailed information about payments and other “transfers of value” worth more than $10 from manufacturers to certain health care providers and teaching hospitals. The aim of this regulation was to increase the transparency of physician and rep relationships and to minimize conflicts of interest.
The result is a system that, whatever its inefficiencies, works to protect patients. Before any MSL or sales rep speaks to an HCP, they go through rigorous onboarding, clinical and product training, compliance certification, roleplay, and competency assessments.
In addition, every piece of content they use in communicating with HCPs undergo a thorough medical-legal-regulatory (MLR) review and approval, with ongoing monitoring and feedback. These aren’t bureaucratic hurdles. They’re the product of an industry that has learned what happens when the stakes are this high, and the guardrails aren’t there.
The question is: why are we not applying the same logic and rigor to AI?
Where Most Companies Are Today
Here’s an uncomfortable truth about where the industry actually stands on AI deployment right now.
Most companies using AI agents in customer-facing or field-adjacent roles have basic prompt guardrails—instructions baked into the system to prevent the most obvious compliance risks. A few organizations have applied meaningful rules that help control what content, data, or systems an AI agent has access to in supporting a specific role. Almost none have the observability infrastructure to know, with any confidence, what their agents are actually saying or doing in the field.
To make this concrete: AI compliance risks might look like a generic AI answer engine like ChatGPT that serves up off-label information to a sales rep who is not allowed to have off-label conversations, or a chatbot hallucinating and providing an MSL with a made-up clinical study. If either of these scenarios happened, how would HQ even know about them? More importantly, what harm might be unknowingly introduced to patients?
The regulatory exposure here is real. FDA regulatory frameworks like 21 CFR Part 202 govern pharmaceutical promotion to keep it on-label, truthful, and in fair balance of risks and benefits. Frameworks like this still apply to AI outputs. For example, if an AI agent says something that a human rep would have been penalized for saying, or the rep repeats inaccurate information they get from an AI tool, the liability remains.
What Compliant AI Looks Like
The good news is that this isn’t a technology problem. The frameworks exist to do it right. What’s needed is the will to apply them. In practice, certifying an AI agent looks remarkably similar to certifying a human—it just requires translating familiar concepts into technical ones. Here’s what that looks like across five best practices:
Pillar 1: Define the Operational Persona
Every certified human in pharma operates within a clearly defined role—with specific mandates, approved content sets, and boundaries on what they can and can’t say. AI agents need the same role-based foundation. That means using job descriptions and role blueprints to set precise professional expectations and boundaries for the system before it ever touches a workflow. An agent supporting an MSL would have vastly different capacities than one supporting a sales rep, even though there might be some workflow overlap.
Pillar 2: Embed Role-Aware Guardrails
Once the persona is defined, the technical boundaries have to match it. This means integrating “no-go zones” directly into the system: hard constraints that prevent the agent from taking actions, surfacing content, or engaging in conversations outside its assigned role. This is the AI equivalent of an approved indication boundary. Without this, you don’t have a role-specific agent—you have a general-purpose system operating in a regulated environment without a leash.
Pillar 3: Connect to Company-Approved Sources Only
One of the most common and underappreciated risks in field AI deployments is source contamination—agents drawing from data, content, or workflows that haven’t been validated or approved. Compliant AI requires that agents only interact with company-approved systems and MLR-approved content. This also ensures that every output the agent produces can be traced back to a source that has cleared the same review process that human-generated content goes through.
Pillar 4: Implement Continuous Observability
If you can’t audit what your agent said, you can’t defend it. Compliant AI requires deploying a control that logs every decision path and tool interaction, creating an immutable audit trail. This goes beyond error logging—it means interaction-level records that allow compliance teams to review, flag, and respond to agent behavior over time. Think of it as the call recording and CRM logging that governs human field activity, applied systematically to AI. Regulators aren’t going to accept “we don’t have that data” as an answer, especially if you’re under the microscope.
Pillar 5: Execute Field-Readiness Certification
Agents don’t go live until they pass a defined bar—full stop. That means subjecting the system to the same rigorous testing and assessments required for human employees before certifying it for real-world use. Similar to how MLR reviews are baked into content creation, the agent could have checkpoints where human review is required to proceed. Just as a new MSL doesn’t walk into an HCP meeting before being certified, an AI agent shouldn’t enter a customer-facing context before it’s been tested, evaluated, and signed off by the people accountable for what it does.
Pillar 6: Ongoing Monitoring and Feedback Loops
Certification isn’t a one-time event for humans, and it shouldn’t be for agents either. Model drift, updated regulatory guidance, and new data sources can all silently degrade an agent’s compliance posture over time. Compliant AI requires scheduled re-evaluation and a clear process for pulling an agent from deployment if something changes.
One more question worth asking: who owns this internally? Is AI certification the responsibility of Medical Affairs? Compliance? IT? Legal? The ambiguity around ownership is itself a risk. Compliant AI requires a named governance structure—not a committee that meets quarterly, but a defined owner with authority to act.
An Opportunity, Not a Burden
It’s tempting to frame AI governance as a brake on innovation, but it isn’t. It’s what makes safe, sustainable innovation possible.
The Life Sciences industry has been here before. When the industry moved to electronic records and validated systems, the companies that invested early in 21 CFR Part 11 compliance weren’t slowed down—they were the ones that scaled. They had infrastructure that could support growth and the validation to make them trustworthy to the industry.
Compliant AI follows a similar pattern. The companies building rigorous governance frameworks now will move faster and more confidently later—because they won’t be the ones pulling agents after an incident, managing a regulatory inquiry, or rebuilding trust with HCPs after a failure.
And for those who argue that certification slows things down: uncertified agents don’t make things move faster—they just move your risk off the balance sheet temporarily, with liability accumulating each day.
Holding AI to Human Standards
We wouldn’t let an uncertified human represent our brand to an HCP. The idea is almost absurd—every person who steps into that role has earned it through a process designed to protect patients, protect the company, and protect the integrity of the industry.
AI agents require the same standard.
The technology is here. The frameworks exist. What the industry needs now is the same intellectual rigor it has always applied to people, applied deliberately and without shortcuts to the AI agents operating in its name.
